These Terms of Service govern your use of the MendDesk AI customer support platform at menddesk.com. By creating an account or using our service, you agree to these terms.
1. Acceptance of Terms
By accessing or using MendDesk ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We may update these Terms at any time; continued use of the Service after changes constitutes acceptance.
2. Description of Service
MendDesk is an AI customer support platform that allows you to deploy an intelligent support agent trained on your knowledge base, past tickets, and product data. The agent resolves customer inquiries across chat, email, Slack, and integrated helpdesks. Features and availability may change at any time with reasonable notice.
3. Accounts and Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Permitted Use
You may use the Service only for lawful business purposes related to customer support. You must not: (a) reverse engineer or attempt to extract source code; (b) use the Service to store or transmit malicious code; (c) interfere with or disrupt the integrity or performance of the Service; (d) attempt to gain unauthorised access to any component of the Service; (e) use the AI agent to generate harmful, deceptive, or illegal content; or (f) use the Service in any way that violates applicable laws or regulations.
5. Data and Privacy
Your use of the Service is governed by our Privacy Policy, incorporated herein by reference. You retain ownership of all data you upload or connect to the Service, including customer conversations and knowledge base content. You grant us a limited licence to process that data solely to provide the Service. We will not sell your data to third parties.
6. Integrations and Connected Sources
When you connect a helpdesk, knowledge base, or other data source to MendDesk, you confirm that you have the authority to do so and that the connection complies with the terms of your provider. You are responsible for the security of your integration credentials. We store credentials encrypted at rest and in transit.
7. Intellectual Property
The Service, including all software, designs, and content, is owned by Apexnova Private Limited and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features. Feedback or suggestions you provide may be used by us without restriction or compensation.
8. Subscription and Billing
Paid plans are billed in advance on a monthly basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of your account. Usage limits apply per plan as described on our pricing page.
9. AI Agent Behaviour
While MendDesk is designed to resolve support tickets accurately, AI-generated responses may occasionally be incorrect. You are responsible for reviewing agent configuration, escalation rules, and monitoring agent performance. We recommend maintaining human oversight for sensitive actions and complex cases.
10. Disclaimers
The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
11. Limitation of Liability
To the maximum extent permitted by law, MendDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service. Our total liability for any claims relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. We may retain data for a limited period as required by law or for legitimate business purposes, after which it will be deleted per our data retention policy.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction in India.
